1. Who we are
Torch Bearer (the "Service") is operated by Torch Bearer Global LLC("Torch Bearer Global LLC", "we", "us", "our"). By accessing or using the Service, you ("you", "user") are entering into a binding agreement with Torch Bearer Global LLC.
2. Acceptance
By creating an account, purchasing a track, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
3. The Service
Torch Bearer provides interactive learning tracks, quizzes, and reference material covering industrial automation, PLCs, ladder logic, SCADA, ICS security, and electrical troubleshooting. Content is provided for educational purposes and is not a substitute for site-specific safety procedures, professional certification, or qualified supervision.
4. Accounts
You must provide accurate information when creating an account and keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent, or abusive purpose;
- Send spam, malware, or other harmful code;
- Infringe the intellectual property or privacy of others;
- Interfere with the security or integrity of the Service, including probing, scanning, scraping, or attempting to bypass access controls;
- Resell, redistribute, sublicense, or share access to paid content with anyone outside your account;
- Reverse-engineer, decompile, or attempt to extract source content.
6. Intellectual property
The Service, including its software, question banks, branding, and documentation, is owned by Torch Bearer Global LLC and is protected by copyright and other intellectual property laws. Open standards and publicly licensed materials cited within the Service remain the property of their respective owners. You receive a limited, non-exclusive, non-transferable right to access the Service for your personal or internal business use within the plan you have purchased.
7. Payments and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, currency, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Refunds are also covered by our Refund Policy.
8. Service availability
We work to keep the Service available, but we do not guarantee that it will be uninterrupted, error-free, or free from security incidents. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Limitation of liability
To the maximum extent permitted by law, Torch Bearer Global LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you paid to us (via Paddle) in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for fraud, death, or personal injury caused by negligence).
10. Indemnification
You agree to indemnify and hold harmless Torch Bearer Global LLC from any claim arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
11. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to access paid content ends; refund eligibility is governed by our Refund Policy.
12. Changes
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of registration of Torch Bearer Global LLC, without regard to its conflict-of-laws rules. Disputes shall be resolved in the courts of competent jurisdiction located therein, except where mandatory consumer law requires otherwise.
